1. Company Information & Legal Status

These Terms & Conditions constitute a binding legal agreement between PolandExportFlow Konrad Lesiak(“PolandExportFlow”, “we”, “us”) and any individual or business entity utilizing our services (“Client”, “you”).

PolandExportFlow operates as an agent and authorized representative of the Client. All funds transferred for Assisted Purchase services are entrusted funds intended solely to cover the cost of goods and transport; they do not constitute Company revenue. The Client remains the legal owner of the items from the moment of purchase, with the Company acting strictly as an intermediary facilitator.

2. Acceptance of Terms

By accessing or using the services provided by PolandExportFlow, you are entering into a binding legal agreement.

  • Agreement to Terms: If you do not agree to these Terms, you must immediately discontinue the use of our services.
  • Legal Capacity: The Client confirms they are at least 18 years old (or of legal age in their jurisdiction) and have the full capacity to enter into binding contracts.
  • Modifications: PolandExportFlow reserves the right to update or modify these Terms at any time without prior notice. Continued use of the service after any changes constitutes full acceptance of the new Terms.

3. General Scope of Services

PolandExportFlow operates as a comprehensive logistics facilitator and intermediary. Our core services include:

  • Parcel Forwarding: Provision of a dedicated Polish address for receiving and forwarding goods to international destinations.
  • Assisted Purchase: Purchasing products on the Client’s behalf from Polish and European sellers (acting strictly as an intermediary).
  • Consolidation & Warehousing: Receiving, storing, and combining multiple parcels into a single shipment to optimize costs.
  • Inspection & Documentation: Visual verification of items and photographic documentation (Real-Item Verification).
  • Secure Repackaging: Professional repacking services designed to secure items for safe international or intercontinental transport.
  • Pickup Services: Personal collection of goods from sellers, manufacturers, or private individuals across Poland.
  • Business Logistics (B2B): Specialized support including office relocations, palletized freight, bulk shipments, and consolidated returns handling.
  • Logistics Coordination: Organizing shipments via trusted carrier partners (e.g., FedEx, DHL, GLS, DPD, InPost).

4. Parcel Forwarding Service

We provide a dedicated Polish address for your global shopping (see details: Parcel Forwarding Process).

4.1 Scope of Service

  • Polish Address: We provide a physical address (warehouse) for receiving goods on behalf of the Client.
  • Receiving & Pickup: We accept deliveries from all major couriers (DHL, DPD, FedEx) and offer pickup from Parcel Lockers (InPost, Orlen Paczka) if the seller ships there.
  • Consolidation: We combine multiple parcels into one secure shipment to reduce international shipping costs (up to 70% savings).
  • Verification: We perform a "Real-Item Verification" (visual check against description) to ensure you didn't receive a "brick" instead of a phone.
  • Global Delivery: We ship to the Client’s specified address via Door-to-Door couriers or to Parcel Lockers (where supported by the destination carrier).

4.2 Restrictions & Client Obligations

  • Correct Addressing: The Client must ensure the shipment includes their unique Suite ID / Name. Unidentified parcels may be delayed or returned to the sender.
  • Prohibited Goods: It is strictly forbidden to forward illegal items, weapons, drugs, hazardous materials, or items restricted by aviation law (see complete Prohibited Items List). We reserve the right to inspect and report such shipments to authorities.
  • Incoming Damage: We are not liable for items that arrive at our warehouse already damaged. We will document the damage and assist with the return.
  • Refusal Rights: We reserve the right to refuse receipts of shipments that are leaking, clearly damaged, or dangerous (COD shipments are not accepted unless pre-arranged).

5. Assisted Purchase Policy

Important: PolandExportFlow acts exclusively as an intermediary (see: Assisted Purchase Process). All funds transferred for purchases are client assets provided to us solely for order execution. We never take legal ownership of the goods and we do not fund purchases using our own capital – we only manage and facilitate the flow of your resources and property in Poland.

5.1 Scope of Service & Financial Rules

  • Purchase Execution: We purchase goods on your behalf from Polish/European stores using our local details and coordinate delivery to our warehouse.
  • Payment Terms: Orders are processed only after 100% prepayment (Item Cost + Service Fee) is received. We do not advance funds for purchases.
  • Price Fluctuations: If the product price increases between the quote and the actual purchase, the Client must pay the difference before we proceed.
  • Stock Availability: If an item goes out of stock after payment, we will refund the full amount. We are not liable for the item's unavailability or lost deals.
  • Returns Management: We facilitate returns to the seller (within their return window). However, return shipping costs and any restocking fees are covered by the Client.

5.2 Client Responsibility & Obligations

  • Product Selection: The Client is solely responsible for the selection, quality, and compatibility of the goods. We do not advise on product suitability.
  • Legality & Compliance: The Client warrants that the items are legal and comply with all import regulations in the destination country. PolandExportFlow is not liable for seized items.
  • No Warranty: As an intermediary, we do not provide product warranties. Any warranty claims must be directed to the original seller or manufacturer.
  • Debt Settlement: The Client is obligated to settle any under-calculated costs (e.g., shipping weight differences) before the goods are released for final export.

6. Pickup Service & On-Site Verification

We offer personal collection and verification throughout Poland (see details: Pickup Service Process).

  • Scope of Service: We offer personal collection from private sellers , manufacturers, or warehouses throughout Poland.
  • Pricing Model: Pickup costs are quoted individually based on the route distance from our hub in Zawiercie, cargo weight, and vehicle requirements.
  • Anti-Scam Verification: Our driver performs a visual On-Site Verification to ensure the item matches the description before collection. This is a visual check only; technical functionality is not tested.
  • Expert Packing: If the seller refuses to pack, we provide protective materials and packing services on-site. Additional fees apply for materials used.
  • Failed Pickup (Dead Run): If the collection fails due to the seller’s fault (e.g., absence, item significantly different from description, refusal to release goods), the Client is liable for 100% of the transport costs incurred.
  • Coordination: We handle all communication with the seller to arrange the collection time and details.

7. Relocation Services (Business & Private)

Comprehensive logistics for both corporate and private needs (see details: Relocation Services).

7.1 Business & Office Logistics (B2B)

  • Scope of Services: Business services may include: office equipment relocation, bulk shipments, consolidated returns handling, palletized freight, and coordination with private carriers.
  • IT & Data Liability: While we transport high-value tech (server racks, workstations), the Client is solely responsible for data backups. We accept no liability for data loss, software corruption, or configuration issues.
  • Business Continuity: Our liability is limited to the physical value of the goods. We are not liable for operational downtime, lost profits, or business interruption caused by transit delays.
  • B2B Terms: All business services are quoted individually and may be subject to separate service agreements. 100% upfront payment is required unless a trade credit agreement is in place.

7.2 Residential & Personal Relocation (B2C)

  • Furniture Disassembly: We offer disassembly and reassembly services. However, we are not responsible for damage due to the natural wear and tear of particle board furniture (e.g., IKEA style) that may lose stability upon reassembly.
  • Specialized Items: Transport of Motorcycles, Vehicles, or Fine Art requires a custom technical assessment and dedicated insurance coverage.
  • Site Access & Delays: The Client must ensure proper access (elevators, parking permits). Waiting time fees apply if our team cannot immediately access the premises at the scheduled time.
  • Packing Standards: If the Client packs their own belongings, we are not liable for damage caused by improper self-packing.

8. Product Information & Client Obligations

  • Data Accuracy: The Client must provide accurate and complete information: description, declared value, true dimensions, weight, and destination address.
  • Quotes are Estimates: Shipping quotes provided before we receive the package are estimates only, based strictly on the data provided by the Client.
  • Price Adjustments: If the actual weight or dimensions (including volumetric weight) exceed the Client’s declaration, the Client is obligated to pay the difference. We will not cover under-calculated shipping costs.
  • Consequences of Errors: Incorrect or incomplete information may result in service refusal, delays, or additional fees.
  • Non-Refundable Funds: If a service is cancelled due to incorrect data or prohibited items, funds already used for the purchase/acquisition of the product are non-refundable.

9. Inspection & Documentation

  • Visual Scope Only: Inspections are strictly visual (external damage check and basic description match). We perform no functional, technical, or electronics testing.
  • No Authenticity Check: The Company does not verify if a product is original or authentic. Authenticity disputes remain solely between the Client and the Seller.
  • Documentation Limitations: Photos and videos provided at the Client’s request are informational only and do not constitute a warranty of quality, condition, or color accuracy.
  • Hidden Defects: PolandExportFlow is not liable for hidden defects or internal damage that is not visible during a standard visual inspection.
  • Returns of Non-Originals: If a product is deemed non-original by the Client based on our photos, the possibility of a return depends entirely on the Seller’s return policy.

10. Storage & Abandonment

  • Free Period: We offer 30 calendar days of free storage for all incoming parcels.
  • Storage Fees: From day 31, a fee of 1€ per kg applies (charged per month/billing cycle).
  • Payment required: Shipments will not be processed or released until all accrued storage fees are settled.
  • Abandonment: Goods stored for over 120 days without payment or instruction will be considered abandoned and disposed of without compensation.

11. Shipping & Delivery

We partner with trusted carriers (FedEx, DHL, GLS, DPD, InPost) to ensure global reach.

  • Carrier Selection: Shipping methods and couriers are selected based on destination, size, weight, and cost-efficiency to ensure the best solution.
  • Timelines & Delays: Estimated delivery times are not guaranteed. PolandExportFlow is not responsible for delays caused by customs inspections, strikes, force majeure events, or regulatory changes.
  • Liability Transfer: Once a parcel is handed over to the courier, responsibility transfers according to the carrier’s terms.
  • Customs & Taxes: The recipient is solely responsible for all import duties and taxes. Failure to pay will result in the package being abandoned or returned at the Client’s expense.
  • Return Costs: The Client covers all costs for returns caused by incorrect addresses, failed delivery attempts, or refused shipments.
  • Volumetric Weight: Shipping costs are calculated based on the greater of the actual weight or volumetric weight.

12. Insurance & Claims

Insurance is optional but highly recommended. The coverage cost and potential compensation are strictly based on the Declared Value.

  • Declared Value Rule: Compensation is calculated based only on the value declared by the Client. We are not liable for the difference in value for undervalued items.
  • Strict Deadlines: Claims must be filed within the courier’s specific timeframe (usually 48-72h). Late submissions are automatically rejected by carriers.
  • No Upfront Compensation: PolandExportFlow cannot advance compensation funds. We transfer the payout only after receiving it from the carrier or insurer.
  • Payout Limit: Compensation is limited strictly to the amount recovered from the carrier. We do not cover deductibles or denied portions of a claim.

CRITICAL: If the package shows external damage, a damage report MUST be signed with the courier upon delivery. For hidden damage, you must notify us within 24h of delivery.

13. Lost or Damaged Shipments

While we ensure shipments are insured, strict protocols must be followed to process a claim successfully.

  • Inspection upon delivery: The recipient is obligated to inspect the external condition of the package in the presence of the courier.
  • Visible Damage: If damage is visible, a formal damage report must be filled out immediately with the courier. Without this document, claims are usually rejected.
  • Claims Assistance: PolandExportFlow assists in the claims process and submits documentation on your behalf.
  • Timeline & Decision: The final decision and compensation amount depend entirely on the Carrier or Insurer. Resolution may take 30 business days or longer.
  • Liability Limit: Compensation is strictly limited to the Declared Value of the goods. We are not liable for undeclared or undervalued items.

14. Payments & Fees

  • All services must be paid in advance. No shipment will be dispatched until all fees are paid in full.

14.1. Accepted payment methods:

  • PayPal
  • Revolut
  • Visa / Mastercard / Apple Pay (via Stripe)

14.2. Additional terms:

  • Commission is calculated based on the Total Order Value (which includes: Value of Goods + Carrier Shipping Costs).
  • Standard rate: 9% (minimum 9€).
  • Orders above 500€: 8% rate.
  • Orders above 2500€: 7% rate.
  • Processing fees are non-refundable.
  • All quotations become binding once accepted.
  • The Client is responsible for any transaction fees or currency conversion costs charged by their bank or payment provider.

15. Refunds & Chargebacks

Refunds are issued strictly in accordance with these Terms and the specific circumstances of the service.

  • Service fees (commissions) are non-refundable once the service execution has commenced.
  • Initiating a chargeback without prior communication results in immediate service suspension.
  • Refunds dependent on carrier compensation are issued ONLY after PolandExportFlow receives the funds. Note: Carrier claim processing usually takes between 30 and 60 days.

Important: We do not offer advance refunds or credits for issues caused by third-party carriers. We act as your representative in the claims process, but we are bound by the carrier’s final decision and timeline.

16. Right to Refuse Service

PolandExportFlow reserves the right to refuse service if:

  • Goods are prohibited, dangerous, or restricted (see Section 7: Prohibited Items).
  • Information provided is misleading or incomplete.
  • The shipment poses excessive risk to our team or carriers.
  • Cooperation becomes abusive, threatening, or unreasonable.

Important: PolandExportFlow is NOT a customs agency. All customs duties, taxes, and import regulations are the sole responsibility of the Client. We are not liable for any delays or seizures by customs authorities.

17. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of Poland.

  • Jurisdiction: Any disputes arising out of or in connection with these Terms shall be resolved exclusively by the competent court having jurisdiction over PolandExportFlow’s registered office in Zawiercie, Poland.
